The primary national legislation governing schools in South Africa, enacted in 1996. Key provisions relevant to this Decision Tool:
- Section 6 places language-of-instruction decisions at each public school with the School Governing Body. The WCED may not override this (confirmed in the Mikro Primary case).
- Section 46 requires independent schools to register with the provincial department; operating an unregistered school is a criminal offence.
