The Supreme Court of Appeal judgment that confirmed a provincial education department may not direct a public school to change its language of instruction. The case established that language policy sits with the School Governing Body under SASA Section 6, and that the WCED cannot override it. This is the legal reason a parent cannot compel Emil Weder to offer English-medium classes if the SGB has set Afrikaans as the medium.
